Colgate Lawsuit Over Charcoal Toothpaste Tossed by Federal Judge

A lawsuit claiming that Colgate misled consumers about the safety of its charcoal toothpaste was dismissed March 31 by a federal judge.

Consumers who sued Colgate argued that its charcoal toothpaste was damaging to teeth, contrary to Colgate’s marketing that the product was “enamel safe.”

In dismissing their lawsuit, Judge Jennifer L. Rochon wrote that consumers didn’t make any allegations with respect to the charcoal contained in Colgate’s toothpaste.

Rochon wrote that consumers don’t “plausibly allege a false, misleading or deceptive act,” and their claims “must therefore be dismissed.”
