Coca-Cola Can’t Shake ‘100% Recyclable’ Water Bottle Label Suit

A group of consumers advanced their proposed class action alleging plastic water bottles manufactured by Coca-Cola Co. and others and labeled “100% Recyclable” were deceptively advertised because the bottles aren’t entirely recyclable.

The claims were bolstered by a survey showing most consumers thought the phrase meant every component of the water bottle, including caps and labels, were recyclable, Judge James Donato of the US District Court for the Northern District of California said Monday, rejecting the defendants’ motion to dismiss the third version of the complaint.
