Champion Petfoods USA Inc. and Champion Petfoods LP convinced a federal court in Wisconsin to throw out—for good—a proposed class suit alleging it deceptively marketed Orijen and Acana dog foods.
Scott Weaver alleged label statements touting Champion’s Orijen and Acana dog food as “biologically appropriate” and made from “fresh regional ingredients” were misleading because of the undisclosed presence of bisphenol A and pentobarbital in the food, and because some ingredients weren’t fresh or regionally sourced.
The U.S. District Court for the Eastern District of Wisconsin wasn’t swayed.
