Champion Petfoods Label Not Deceptive, Eighth Circuit Affirms

Two dog owners failed Tuesday to convince the Eighth Circuit that Champion Petfoods USA Inc. duped them and proposed class members about the quality of its Orijen and Acana products, marking the company’s second appellate victory in two months.

Jennifer Song and Scott Wertkin alleged Champion deceptively marketed the food as “Biologically Appropriate” and made with “Fresh Regional Ingredients” when it contained heavy metals and included non-fresh, non-regional ingredients.
