Dog owners failed to show that Champion Petfoods USA Inc. made false or misleading representations on its Acana or Orijen products, the Tenth Circuit affirmed Tuesday, saying phrases like the pet food is “Trusted Everywhere” are vague statements that can’t support consumer deception claims.
Cammeo Renfro and others brought a proposed class action against Champion, raising various claims under Colorado law. They challenged package statements touting the food as “Biologically Appropriate,” “Trusted Everywhere,” using “Fresh and Regional Ingredients,” and containing “Ingredients We Love [From] People We Trust.”
