The California Supreme Court will review a ruling denying class certification in a suit against Rite Aid Corp. by owners of inflatable pools allegedly deceived by the product’s smaller-than-expected size.
The plaintiffs’ bid for class certification under the California Consumers Legal Remedies Act, Unfair Competition Law, and False Advertising Law was rejected by the California Court of Appeals in December 2017.
The appellate court said the consumers, who lacked sales receipts, didn’t demonstrate how the court should verify or notify purchasers of any of the 20,000 “Kids Stuff Ready Set Pools” sold by Rite Aid.
