Bump Stock Case Gets 5th Cir. Rehearing as Issue Awaits SCOTUS

A bump stock proponent will have another chance to convince the Fifth Circuit that a federal ban on the firearm accessories is invalid, after the full appeals court voted to hear his case.

The grant of rehearing Thursday takes place against the backdrop of two cases on the same issue now lined up for possible US Supreme Court review. The appeals courts in those cases upheld the Bureau of Alcohol, Tobacco, Firearms and Explosives’ interpretation of a law banning civilan possession of machine guns, but with deep divisions.
