The Budd Co. failed to win the exclusion of expert witnesses from an upcoming trial by the estate of a railroad employee who died of mesothelioma.
The estate may call a doctor who is an expert in lung disease to say every exposure to asbestos above naturally-occurring levels contributes to the development of the disease, the District of Kansas said Nov. 20.
Dr. Arnold Brody’s testimony is reliable because it rests on general scientific principles about how asbestos exposure causes mesothelioma.
