Boiron Wins Verdict in Flu Remedy Label Class Suit

Boiron Inc. won a verdict in a suit brought by a certified class who alleged the homeopathic drugmaker deceived consumers into buying a flu remedy that didn’t work (Lewert v. Boiron, Inc., C.D. Cal., 11-10803, verdict 6/16/16).

Christopher Lewert, representing a California class, sued under California’s Unfair Competition Law and Consumers Legal Remedies Act. Plaintiffs alleged the company’s Oscillococcinum (Oscillo) product is effectively a sugar pill that—based on scientific principles—can’t relieve flu-like symptoms.

But a jury in the U.S. District Court for the Central District of California disagreed.
