BNSF Railway Beats Worker’s Toxic Exposure Claims

BNSF Railway won dismissal of claims by the estate of a railroad worker who died of bladder cancer allegedly caused by his workplace exposure to toxic substances.

The estate of Beauford Jenkins only made vague allegations and offered no scientific evidence to support the claims, the U.S. District Court for the Northern District of Texas said.

There was no evidence that anything happened while Mr. Jenkins was at work that caused him to suffer an injury, the court said.
