BMW Lemon Law Suit Headed Back to State Court

BMW of North America LLC can’t keep a California plaintiff’s lemon law suit in federal court.

The U.S. District Court for the Eastern District of California can’t hear the case because BMW LLC failed to show that it and the plaintiff were citizens of different states, the court said.

Companies generally prefer to litigate in federal courts, which are perceived to be more business-friendly than state courts. Plaintiffs often believe state courts will better protect their rights.
