Big Lots Inc. is entitled to legal fees from a plaintiff’s attorney in a failed proposed class action alleging the retailer’s Fresh Finds coffee was mislabeled, after a federal judge criticized the lawyer’s litigation tactics.
Prolific consumer class action attorney Spencer Sheehan of Sheehan & Associates PC was ordered Wednesday by the US District Court for the Middle District of Florida to pay Big Lots more than $144,000 in attorneys’ fees.
Judge Gregory A. Presnell noted that squabbling over the total fees reflected “yet another example of Sheehan’s self-serving conduct in this case.”
