Bayer’s One A Day Vitamin ‘Means’ One a Day, Court Rules (1)

A lawsuit claiming that Bayer Corp. violates California consumer protection laws in its marketing of One A Day gummy vitamins can go forward, the California Court of Appeal held.

A reasonable consumer is the standard for misleading claims, and the discrepancy between the well-known One A Day name and its literal meaning and the “miniscule” print on the back of the bottle indicating that two gummies are required to meet the recommended daily allowances is misleading, the court said in an opinion by Judge William W. Bedsworth.
