Bayer Must Face Essure Suit in Illinois State Court

Bayer Corp. and related companies must face a suit in Illinois state court by 18 women who allege harm stemming from their use of Bayer’s Essure contraceptive, the Southern District of Illinois ruled.

The U.S. District Court for the Southern District of Illinois said it lacks jurisdiction over the suit, brought by 17 Illinois residents and one woman from Indiana who allege they suffered health issues and unintended pregnancies.

Essure consists of two coils that get placed in the fallopian tubes and cause the formation of scar tissue that creates a barrier to fertilization.
