BASF’s Superfund Claims Go Forward for Hudson River Cleanup

BASF Corp. can proceed with Superfund claims against AMRI Rensselaer Inc. to recoup costs spent on the cleanup of the Hudson River, after the Northern District of New York found the company faces liability as the owner of a property from which there was a release even if there is no ongoing release.

The U.S. District Court for the Northern District of New York also rejected AMRI Rensselaer’s argument that it can’t be liable as an owner because it doesn’t own the contaminated portion of the river for which BASF seeks to recover.
