Banana Republic Gets Suit Over Lack of Braille Gift Cards Tossed

Banana Republic LLC won dismissal of claims it violated the Americans with Disabilities Act by failing to provide braille gift cards to visually impaired customers, after the Southern District of New York held that the law doesn’t govern the type of merchandise that a retailer sells.

The ADA bars places of public accommodation from discriminating on the basis of disability when providing access to goods and services. But the law doesn’t require provision of different goods or services, just nondiscriminatory enjoyment of those that are provided, the US District Court for the Southern District of New York said Thursday.
