Asphyxiated Teen’s Family Loses vs. Oxygen System Maker

The parents of an autistic teenager who asphyxiated while using a portable hyperbaric oxygen system in their home can’t recover damages from the maker of the system, the U.S. District Court for the Eastern District of North Carolina says (Sparks v. Oxy-Health, LLC, E.D.N.C., 5:13-cv-00649, 9/15/15).

Amy and Dylan Sparks failed to read the reference manual sold with the Vitaeris 320 Hyperbaric Oxygen Therapy Chamber System, and failed to comply with other warnings on the chamber, according to Judge Louise Wood Flanagan’s Sept. 15 ruling.
