Amazon.com Inc. shouldn’t face liability for a web “marketplace” sale that allegedly led to a Pennsylvania woman’s injuries both because it’s immune from suit and a contrary holding would harm the U.S. economy, pro-business groups and technology organizations told the full Third Circuit.
A prior decision from a three-judge panel in favor of the injured woman incorrectly concluded that Amazon can be held liable as a product “seller” under Pennsylvania law, the U.S. Chamber of Commerce and its state counterpart said in an Oct. 24 brief filed with the full U.S. Court of Appeals for the Third Circuit.
