Allergan Breast Implant Suit Tossed, but Plaintiff May Refile

Allergan USA Inc. won dismissal of a woman’s suit over an allegedly flawed silicone breast implant, as a federal trial court in Louisiana said plaintiff Sheridan Allo failed to adequately plead a non-preempted “parallel” claim.

Allo didn’t include enough factual detail to state a viable medical device product liability claim but she may try again, the U.S. District Court for the Eastern District of Louisiana said.

Allo received two Allergan Natrelle Style 410 FX breast implants in 2016 following a bilateral mastectomy. She had them removed in 2019 because of pain, and her doctor determined the right implant had partially ...
