Allergan Breast Implant Defect Suit Advances

Allergan USA Inc. must face a woman’s breast implant suit after a federal trial court in Louisiana said Sheridan Allo stated non-preempted product defect claims.

The U.S. District Court for the Eastern District of Louisiana had dismissed Allo’s earlier complaint, but found her amended pleading sufficient to proceed this time around.

Allo received two Allergan Natrelle Style 410 FX breast implants in 2016 following a bilateral mastectomy. She had them removed in 2019 because of pain, and her doctor determined the right implant had partially collapsed. Her lawsuit followed.
