ADHD Medicine Maker Sheds Most of Empty Capsule Class Action

Takeda Pharmaceuticals USA Inc. defeated most claims in a proposed class action alleging the company violated consumer protection laws prohibiting deceptive acts by selling empty and underfilled capsules of the ADHD drug Vyvanse.

“Although it is troubling to contemplate a consumer receiving empty capsules in the place of prescribed medication,” the complaint failed to establish Takeda made an error that rose beyond negligence, the US District Court for the District of Massachusetts said Wednesday.

Lead plaintiff Gunter Crommelin sued the pharmaceutical company after she opened capsules in her presecription for Vyvanse, which is used to treat attention-deficit/hyperactivity disorder. Five capsules ...
