The survivors of a mesothelioma victim who died less than six weeks after his diagnosis will receive $3.8 million in damages under a split decision of a Louisiana appeals court (White v. Entergy Gulf States Louisiana, LLC, 2014 BL 317549, La. Ct. App., 11/10/14).
The Louisiana Court of Appeal, First Circuit affirmed the award in a 4-1 decision authored by Judge Ernest G. Drake. The court held that there was sufficient evidence to support the trial court’s judgment and no indication it improperly considered evidence outside the scope of the survival claim.
