Yum! Brands Gets Biometric Privacy Lawsuit Sent to Arbitrator

A woman must individually arbitrate her would-be class claims that Yum! Brands Inc. and three subsidiaries violated the Illinois Biometric Information Privacy Act through a fingerprint-timekeeping system at Taco Bell franchises, a federal court ruled.

An arbitration agreement between plaintiff Kimberly Coons and non-party Bell American Group LLC was enforceable by Yum! and its subsidiaries, Judge Stephen P. McGlynn of the US District Court for the Southern District of Illinois said Tuesday.

This was because Coons’ lawsuit included allegations that franchisee Bell American’s actions should be imputed to the defendants, McGlynn said.
