SunPath Ltd. must face a proposed class action lawsuit over unwanted robocalls aftera federal judge ruled denied the vehicle service contract agency’s motion to dismiss it.
Lead plaintiff Kurt Morales claims that SunPath created lists of thousands of vehicle owners from various public records and then aggressively contacted them with automated calls which falsely told individuals that their vehicle warranty was going to expire. What’s more, Morales alleges that the warranty extensions SunPath offered via robocall were not actual warranties, and were used as a ploy to market and sell vehicle service contracts.
