Whistleblower Denials Not Subject to Review, Appeals Court Says

A former Wells Fargo & Co. employee who had her federal whistleblower complaint over pre-financial crisis mortgage practices denied isn’t entitled to a review of the Justice Department’s decision, a federal appeals court said Thursday.

Federal courts have no authority to review government determinations that whistleblowers aren’t entitled to cash payouts under the 1990 Financial Institutions Anti-Fraud Enforcement Act, the US Court of Appeals for the Federal Circuit ruled.

The ruling affirmed a May 2024 ruling by the US Court of Federal Claims.
