Video Privacy Suit Against America’s Test Kitchen Can Proceed

America’s Test Kitchen must face a proposed class action alleging it disclosed information to Facebook about the video-viewing histories of website visitors without their consent in violation of the Video Privacy Protection Act.

A mandatory arbitration agreement in the cooking website’s terms and conditions wasn’t enforceable because the terms and conditions weren’t conspicuous enough to give visitors notice of the agreement, Judge Angel Kelley of the US District Court for the District of Massachusetts said Friday.
