Verizon Not Liable for Employee Theft of Customer’s Nude Photos

Verizon Wireless won dismissal of a customer’s claims that an employee at a Verizon store forwarded nude photos of her from her cellphone to his without consent.

Verizon isn’t liable for employee Brandon Kostick’s alleged actions because the conduct isn’t “of a kind and nature” that he was employed to perform, the U.S. District Court for the Middle District of Pennsylvania said July 18.

“No conceivable explanation” exists as to how the employee’s conduct would serve Verizon’s business, the court said.
