Toyota, Progressive Insurance Can Arbitrate Driver Data Suit

Toyota Motor North America Inc and Progressive Insurance can arbitrate a driver’s claims over the automaker sharing driving data with the insurance company and other third parties, a court ruled.

The arbitration agreement that Philip Siefke signed with Toyota when he downloaded the automaker’s app satisfied the elements of a valid contract, was enforceable, and should be reviewed by an arbitrator, according to the order from the US District Court for the Eastern District of Texas. The pact extends to Progressive and Toyota’s data analytics servicer.
