TomTom’s assurance of lifetime navigation support induced consumers who wouldn’t otherwise have paid as much for the devices, including GO, ONE, and XL models, Francis McVetty alleges.
In a January 2018 announcement terminating lifetime updates, TomTom said the change was caused by technological limitations—older devices can’t run newer maps and software, the suit alleged.
But this explanation is contrary to the capabilities of the devices and to basic fair dealing, according to the suit.
