An Elemetal LLC customer withdrew a proposed class action accusing the precious-metal refiner of violating California laws by not implementing cybersecurity protections, enabling a 2023 breach that exposed more than 10,000 individuals’ data.
California resident and Elemetal customer Joseph Hinesley Sr. dropped his suit in a Feb. 7 notice of voluntary dismissal, with prejudice, filed in the US District Court for the Northern District of Texas.
Hinesley’s October complaint alleged Houston-based Elemetal’s lack of security protocols and failure to timely notify customers of the 2023 breach violated California’s Unfair Competition Law and the California Consumer Privacy Act.
