Tampa General Hospital Data Breach Suits Head to State Court

A proposed class action alleging that Tampa General Hospital failed to protect the personal information of more than 1.2 million people in a 2023 data breach was sent back to state court Wednesday, the fifth lawsuit against the hospital to be bounced out of federal court since June.

The trend suggests that litigation over the breach will likely unfold in state court only in the wake of key recent rulings by Judge Kathryn Kimball Mizelle of the US District Court for the Middle District of Florida that identified barriers to federal jurisdiction in two other lawsuits against the hospital.
