T-Mobile Faces Computer Fraud Claims in SIM-Swap Class Action

T-Mobile USA Inc. must face several proposed class action claims from a victim of an alleged SIM-swapping data scam, a Washington federal judge ruled.

Judge John H. Chun of the US District Court for the Western District of Washington on Friday allowed plaintiff Eman Bayani’s allegations that T-Mobile violated the Federal Communications Act, Computer Fraud and Abuse Act, and Washington’s Consumer Protection Act to stand.

The judge dismissed claims that that T-Mobile violated federal law to safeguard the privacy of consumer’s proprietary telecommunications network data. The judge also dimissed a claim under the Stored Communications Act that T-Mobile “knowingly” divulvged ...
