Supreme Court Won’t Hear Case on Biden ACA Transgender Guidance

The US Supreme Court on Monday declined to hear a lawsuit over the Biden administration’s guidance banning health-care providers from discriminating against transgender individuals—guidance the Trump administration has already rescinded.

The Trump administration urged the court to reject the case, upholding the US Court of Appeals for the Fifth Circuit’s ruling that plaintiffs Susan Neese and James Hurly lacked standing to sue. The two doctors agreed the case is moot, but were seeking for the ruling to be overturned.
