The US Supreme Court won’t consider the scope of a landmark ruling requiring juries, not judges, to find certain facts in a criminal trial.
In the cases denied Monday, the justices declined to determine whether the facts underlying a criminal restitution order must be submitted to a jury, or whether a judge alone can decide them.
Dissenting from the court’s decision not to hear the case, Justice Neal Gorsuch said that in “the absence of this Court’s review, I can only hope that federal and state courts will continue to consider carefully the Sixth Amendment’s application to criminal restitution orders.” ...
