Supply Network Inc. must face a lawsuit alleging it collected the fingerprints and hand geometry of its employees in violation of the Illinois Biometric Information Privacy Act, a federal court said Wednesday.
Plaintiff Jeffrey Schwartz sufficiently alleged that the company disseminated his biometric information to its payroll vendor without his knowledge or consent, Judge Charles P. Kocoras of the US District Court for the Northern District of Illinois said.
Kocoras also rejected the company’s arguments for dismissal based on judicial estoppel, laches, and ripeness.
