Kiwi ignored Southwest’s cease and desist requests and continued to scrape Southwest’s flight information from its website and has resold over 20,000 Southwest tickets to consumers at a markup.
Southwest asserted a breach of contract claim against Kiwi, among other claims. It said that when Kiwi purchases a Southwest ticket, it agrees to the terms and conditions on its website, which specifically forbid page scraping.
