A proposed class action against a life insurance company for unwanted text messages can proceed, a California federal judge ruled, finding that a telephone number used for both business and personal purposes could be protected under the Telephone Consumer Protection Act.
Kyle Miholich’s phone number, registered as a “business phone,” received multiple unauthorized text messages from Senior Life Insurance Co. advertising the Georgia company’s financial webinar. Because Miholich claimed that he also used the phone for personal purposes, to call his family and friends, Miholich contended that he had a privacy interest under the TCPA.
