Northeast Radiology PC and Alliance HealthCare Services won’t have to face a proposed data breach class action because the plaintiffs didn’t allege a cognizable injury, a Manhattan federal judge ruled.
Jose Aponte II and Lisa Rosenberg sued the two radiology companies in July 2021, alleging that they failed to protect sensitive health data from authorized access, leading to the exposure of over 1.2 million patients’ medical records. That includes over 60 million X-rays, CT scans, MRIs, medical test results, and diagnoses, as well as Social Security numbers, names, and addresses, the plaintiffs said.
