Identity-verification company Yoti Inc. moved a proposed biometric privacy class action it’s facing to Illinois federal court, arguing it was incorrectly filed in state court.
The lawsuit should be litigated in federal court because it meets the diversity of citizenship and amount in controversy requirements of the Class Action Fairness Act, the company said in a notice of removal filed Thursday in the US District Court for the Southern District of Illinois.
Attorneys representing the proposed class didn’t immediately respond to a request for comment.
