Postmates Escapes Robotext Claim in California

Postmates Inc. won dismissal of a lawsuit in a California federal district court claiming it sent unsolicited text messages, with a judge saying the plaintiff failed to sufficiently allege the company was liable.

The plaintiff’s putative class complaint doesn’t clearly allege Postmates sent texts, or what relationship a sender may have had with the food-delivery company, the U.S. District Court for the Northern District of California said. The court granted Postmates’ motion to dismiss the claim under the Telephone Consumer Protection Act.
