Point-of-Sale System Company Must Face Biometric Privacy Suit

A company selling point-of-sale technology must face a proposed biometric privacy class action since plaintiffs adequately alleged violations of the Biometric Information Privacy Act, an Illinois federal judge ruled.

Plaintiff Ronesha Smith adequately stated a claim that Signature Systems Inc. took and retained fingerprint data in violation of the statute, Judge Mary M. Rowland wrote in an opinion filed Monday in the U.S. District Court for the Northern District of Illinois.

Signature’s counsel didn’t immediately respond to a request for comment.
