A Pet Supermarket Inc. customer didn’t have standing to file a proposed class action in state court alleging the company sent him promotional texts in violation of the Telephone Consumer Protection Act, a Florida appeals court ruled.
Plaintiff Troy Eldridge failed to show he suffered harm from the texts, either in the form of a procedural violation or an intrusion into his privacy, Judge Fleur J. Lobree of the Florida Court of Appeal, Third District, said Wednesday.
