Pacific Sunwear Consumer Advances Suit Over Spyware in Emails

Pacific Sunwear of California LLC must face a proposed class action alleging it collected consumers’ personal information through tracking tools embedded in marketing emails in violation of Arizona privacy law.

Plaintiff Anthony Williams’ allegations of wrongdoing within the forum state were enough for the US District Court for the District of Arizona to exercise personal jurisdiction over the California-based company, Judge John J. Tuchi said Wednesday.

Tuchi denied Pacific Sunwear’s motion to dismiss for lack of jurisdiction, and denied as moot motions filed by Williams aimed at addressing the jurisdictional question.
