Freestyle Software Inc. failed for the second time to defeat Penn LLC’s breach of contract lawsuit in connection with a data breach that exposed the personal information of 236,000 customers of the online retailer, although some claims were trimmed.
Penn, a seller of as-seen-on-TV products on its PulseTV.com website, accused Freestyle of causing over $30 million in business losses by exposing the financial data of its customers for over a year. Freestyle, a provider of internet shopping-cart services, neglected to maintain backups or use a monitoring system to detect unauthorized access, according to the lawsuit.
