Nursing Homes Defeat Some Claims Over Accessibility Concerns

Brookdale Senior Living Inc. trimmed some of the claims from subclasses of residents who allege its facilities discriminate against disabled residents, according to a district court order Friday.

The US District Court for the Northern District of California granted Brookdale partial summary judgment on some of the plaintiffs’ claims under the Americans with Disabilities Act and California’s Unruh Civil Rights Act, according to an order. Judge Haywood S. Gilliam Jr. ruled that one of the plaintiffs’ Unruh claims fail as a matter of law and two subclasses failed to bring Unruh claims about Brookdale’s new construction facilities.
