Nursing Home Affiliate Says Labor Laws Preempt Biometric Claims

A proposed biometric privacy class action against Glenview Terrace Property LLC should be dismissed because the claims are preempted by labor laws, the Chicago-area nursing home affiliate argued.

Plaintiff Sophia Biloche’s Biometric Information Privacy Act claims are preempted by the Labor Management Relations Act and the Illinois Workers’ Compensation Act, Glenview argued in a motion to dismiss filed Monday in the U.S. District Court for the Northern District of Illinois.

Attorneys representing Biloche didn’t immediately respond to a request for comment.
