Noom Beats Wiretapping Class Action Over Session Replay Code

Weight-loss app Noom Inc. defeated a putative class action lawsuit alleging it violated Maryland wiretapping law by tracking her interaction with its website.

The US District Court for the District of Maryland granted Noom’s motion to dismiss the case Wednesday. In her opinion, Judge Julie Rubin said that the plaintiff, Marilyn Hernandez, lacked standing to bring suit under Maryland’s wiretapping law because her complaint “does not adequately allege facts of targeting or misuse of her personal data” or to suggest her activities will be used to steal her identity.
