NBCUniversal Seeks Dismissal of Mobile App Privacy Suit

Users of mobile apps offered by NBCUniversal Media LLC and its subsidiary Peacock TV failed to plead viable claims that the media distributors broke state and US privacy laws prohibiting third parties from recording information about the videos they had watched, the companies told a federal court.

The class action plaintiffs didn’t adequately address elements of New York’s Video Consumer Protection Act and Deceptive Trade Practices Act, as well as the federal Video Privacy Protection Act, the companies said in a motion to dismiss filed Jan. 19 in the US District Court for the Southern District of New York.
