MLB Beats Mass-Arbitration Effort by Video-Privacy Claimants

MLB Advanced Media LP defeated for now a mass-arbitration attempt launched by 5,628 customers bringing video-privacy claims, but the sports-media provider will have to face limited discovery to determine whether the parties agreed to arbitrate such disputes.

Judge Analisa Torres of the US District Court for the Southern District of New York denied the claimants’ petition to compel arbitration March 27. She found they failed to show that a binding arbitration agreement in the company’s 2020 terms of use was still in force after MLB Advanced Media updated the TOU in 2024 and removed the arbitration agreement.
