Tennessee-based Memorial Heart Institute LLC must face some of the claims in a proposed class action alleging it negligently failed to protect the personal information of more than 400,000 current and former patients that was exposed in an April 2023 data breach.
The plaintiffs in the consolidated litigation pleaded sufficient facts to state claims of negligence and breach of implied contract, Judge Curtis L. Collier of the US District Court for the Eastern District of Tennessee said Thursday.
